Effort to repeal workers' compensation reforms under way in California

An initiative to repeal most of the workers' compensation reforms enacted over three years in California has gotten the go-ahead to begin collecting signatures. The initiative, led by worker’s compensation plaintiff attorney William Morris, needs 433,971 signatures by Sept. 10 to be put on a statewide ballot next year.

Among other things, it would reinstate the unlimited right of an injured worker to choose his or her own doctor, eliminate the right of employers to challenge treatment and diagnostic evaluations, and eliminate the need for most pre-approvals for medical treatment of injured workers.

As expected, big business is already on the offensive with the California Chamber of Commerce forming a coalition to fight the measure. Earlier attempts to roll back some of the enacted reforms either lacked legislative support or were vetoed by Gov. Arnold Schwarzenegger.

This will be another interesting legislative fight to watch.
